Club Sandwich purpose

Club Sandwich is a web platform hosted by Palmerston North City Council (PNCC) that serves as a single source of valid information on active clubs within the Palmerston North City boundary. Clubs can register a club profile, manage and update their details on the platform for free. Potential club members can browse the platform and make enquiries to clubs via the platform, or directly to a club by using the contact details provided on a club profile.

We endeavour to make every reasonable effort to maintain current and accurate information on this site. Information contained has been assembled in good faith. Where appropriate, external links have been provided for the user’s convenience. Palmerston North City Council does not accept any responsibility for the content or condition of any external links on this site. In the event that it is determined by PNCC that any content or links are offensive, Palmerston North City Council reserves the right to remove the link or content. PNCC will not be liable for any unintended or unconsented use by another party of any information or images provided by Clubs and included on the Club Sandwich website.

Limitation of liability

Except as expressly prohibited by law, in no event will PNCC or Club Sandwich be liable to you for any direct, indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even where PNCC Club Sandwich has been advised of the possibility of such damages occurring. If, notwithstanding the foregoing, the PNCC Club Sandwich is found to be liable to you for any damage or loss which arises as a result of your use of the website, PNCC's liability shall not exceed the dollar amount of the transaction which formed the basis of the damage or $10.00, whichever is the lesser.

Use of the Club Sandwich website

By registering with and using this website you acknowledge and agree that you will:

PNCC shall not be liable for any damages resulting from any security breaches, unauthorised and/or fraudulent use or access of our services with your login details;

  • Not disclose your password to anyone, including PNCC staff (please note that PNCC staff will never ask you for your password);

  • Take care when answering your registration questions to ensure the information you supply is accurate, complete and suitable for publication;
  • Keep your service contact details up to date; and
  • Notify us immediately if staff are leaving your club who have access to accounts and services belonging to your club.

Subject to the restrictions below, you are allowed to hyperlink to our home page at Club Sandwich. We have no responsibility for the content available on any website which links, mirrors or frames our services or any part of it. In no circumstances will we be considered to be associated or affiliated in whatever manner with any trademarks, trade names, service marks, logos, insignia or other devices used or appearing on websites that links, mirrors or frames our online services or any part of it.

We have made every reasonable effort to provide current and accurate information through the Club Sandwich website and we provide it in good faith. However, by accessing the page and providing information you acknowledge and accept that we have not prepared this information, it has been provided by and for Clubs and we do not accept responsibility for ensuring this is correct on an ongoing or initial basis. We hereby disclaim all liability and responsibility to update our service. PNCC does not guarantee the accuracy and completeness of all information supplied and cannot accept responsibility for any actions taken from this information or information provided from any external links from this site. Users are advised to use their own judgement.

Palmerston North City Council does not have control over the content or policies of any external sites which we link to for public convenience. Any such links have been provided by Clubs to enable you to contact the Club directly, or to provide you with more information on them.

By signing up and continuing to use Club Sandwich, you confirm that you are authorised to provide the information on behalf by and on behalf of the Club. Where PNCC determines that someone is acting without authority, PNCC shall be entitled to remove reference to the Club on the website.

PNCC may at any time without prior notice or any liability to you, cancel or suspend any or all Club Sandwich services and/or to substitute alternative services, which may or may not be interactive or transactional in nature.

Jurisdiction

These terms and conditions are governed by New Zealand law. New Zealand Courts have exclusive jurisdiction over any matter in connection with the online services and these terms and conditions.

Support hours

PNCC Club Sandwich provides customer support for online services between the hours of 8am and 5pm Monday to Friday. All queries outside these hours will be logged and attended to during normal business hours.

Disputes

Any dispute in connection with these Terms or our online services will first be notified to the other party by either party. Both you and PNCC will use all reasonable efforts in good faith to resolve the dispute. Both you and PNCC agree to promptly endeavour to resolve the dispute. If the dispute is still not resolved to either party's satisfaction either party may proceed to mediation in accordance with AMINZ policies to resolve the issue.

Amendments to terms

We may revise these terms at any time and such revision is effective upon publication on our online services. You are responsible for ensuring that you have read the most current version of these terms. Your continued access and/or use of our services will be deemed to constitute your conclusive acceptance of the revised terms. Our online services are subject to change including, without limitation, modification, deletion or replacement thereof without notice.
